1. Title IX - Sex Based Discrimination
Title IX- Sex Based Discrimination:
New Jerusalem Elementary School District (NJESD) adheres to all federal, state, and local civil rights laws that prohibit sex discrimination and sex-based harassment in employment and education. NJESD does not discriminate in its admissions, employment, educational programs, or educational activities on the basis of sex.
Title IX of the Education Amendments of 1972 is one of several federal and state anti-discrimination laws that ensures equality in education. Title IX prohibits discrimination, harassment, exclusion, denial, limitation, or separation based on sex or gender. Title IX applies to male and female students and employees in any educational institution receiving federal funding. No district student or employee shall be excluded from participating in, denied the benefits of, or be subject to harassment or other discrimination in any academic or extracurricular program or activity based on sex.
California state law includes additional protected characteristics: sexual orientation, gender, gender identity, and gender expression. California Education Code Sections 200-282 and NJESD Board Policy 0410 prohibit discrimination based on sex, sexual orientation, gender, and gender identity or gender expression.
NJESD also prohibits retaliation against any person opposing sex discrimination or sex-based harassment or participating in any internal or external investigation or complaint process related to allegations of sex discrimination.
Any NJESD employee or student who acts to deny, deprive, or limit the educational, employment, or social access, opportunities, and/or benefits of any member of the NJESD community on the basis of sex is in violation of the California state and/or federal law.

STATEMENT FOR NON-DISCRIMINATION
NJESD strives to provide a welcoming, safe, and supportive environment that allows all students and staff equal access to opportunities in the district’s academic, extracurricular, and other educational programs, services, and activities. All discriminatory harassment, intimidation, and bullying of any student or staff member by anyone based on the person’s actual or perceived race, color, ancestry, nationality, national origin, immigration status, ethnic group identification, ethnicity, age, religion, pregnancy, childbirth, termination of pregnancy, lactation status, family status, physical or mental disability, medical condition, sex, sex stereotype, sex characteristics, sexual orientation, gender, gender identity, gender expression, genetic information, or association with a person or group with one or more of these actual or perceived characteristics is prohibited.
3. Americans with Disability Act (ADA)
New Jerusalem Elementary School District (NJESD) is committed to achieving full compliance with the Americans with Disabilities Act.
NJSED DOES NOT:
- Deny the benefits of District programs, services and activities to qualified individuals with a disability on the basis of a disability.
- Discriminate on the basis of disability in access to or provision of programs, services, activities of the District, or application for employment or employment to qualified individuals with disabilities.
- Provide separate, unequal or different programs, services or activities, unless the separate or different programs are necessary to ensure that the benefits and services are equally effective.
NJESD operates its programs so that, when viewed in their entirety, they are readily accessible to or usable by individuals with disabilities.
NJESD welcomes those with disabilities to participate fully in the programs, services and activities offered to students, parents, guardians and members of the public. If you need a disability-related modification or accommodation, including auxiliary aids or services, to participate in any program, service or activity offered to you, contact the district ADA Coordinator at least 48 hours before the scheduled event so that we may make every reasonable effort to accommodate you. [Government Code Section 54953.2; Americans with Disabilities Act of 1990, Section 202 (42 U.S.C. Section 12132).]
The U.S. Department of Education has recognized the importance of extracurricular activities, particularly club, intramural and interscholastic athletics in the daily lives of all students including qualified students with disabilities. NJESD wishes to be responsive and compliant with this law and to that end has and will implement appropriate procedures to assess a student with disabilities qualifications to participate in extracurricular activities, work with the appropriate organizations, leagues and clubs to ensure compliance, and work to provide reasonable accommodation whenever practicable and consistent with the stated purpose of Section 504 of the Rehabilitation Act and Title II of the Americans with Disabilities Act.
